These Terms and Conditions (“Terms”) govern your access to and use of the Enigmatic Docs website and services. By using our website, purchasing our services, or engaging with our business in any way, you agree to be bound by these Terms.
Enigmatic Docs operates in South Africa and complies with applicable South African laws, including the Consumer Protection Act (CPA) and Protection of Personal Information Act (POPIA) where applicable.
1. Definitions
- “We”, “Us”, “Our” refer to Enigmatic Docs.
- “You”, “Customer”, “Client” refer to any person or organisation using our services.
- “Services” refer to our offerings including publishing support, e-book services, cover design, editing, proofreading, data entry, hosting assistance, business registration support, and related consulting services.
- “Digital Products” refer to e-books and downloadable files.
2. Nature of Services
Enigmatic Docs provides publishing support and digital services. We are not a traditional publishing house and do not guarantee book sales, distribution outcomes, or commercial success.
Some services involve third-party platforms or tools, and we may act only as a facilitator in such cases.
3. Pricing, Quotes & Payments
All eBook sales are subject to a 70/30 revenue split, with 70% going to the author/rights holder. Payments will be processed monthly via EFT, for sales completed seven days prior. Enigmatic Docs PTY Ltd reserves the right to update the revenue split or payment terms at any time, with changes reflected in the T&Cs.
- Quotes are valid for 7–14 days unless stated otherwise.
- Work on any service will only begin after payment or deposit is received.
- Some services may require full upfront payment.
- Prices may change without prior notice, but confirmed quotes remain valid.
- Payment gateways used may include Paystack, PayPal, or bank EFT.
For custom service requests submitted via our service request form, clients will receive a quote outlining:
- Scope of work
- Deliverables
- Timelines
- Payment terms
Acceptance of the quote constitutes agreement to these Terms.
4. Digital Products (E-Books) – No Refund Policy
Because e-books and digital files are instantly delivered and accessible once downloaded, all digital purchases are non-refundable and non-returnable.
By purchasing a digital product, you acknowledge that:
- Access is granted immediately upon payment
- Digital files cannot be “returned”
- Refunds are not provided for change of mind or misunderstanding of content
If a file is corrupted or inaccessible, we will assist in re-sending or repairing access.
5. Service Delivery & Client Responsibilities
Clients must provide:
- Accurate and complete project information
- Manuscripts or files in workable formats
- Responses, approvals, or feedback within reasonable timeframes
Delays caused by the client may result in project extensions or rescheduling.
We reserve the right to decline projects that include:
- Plagiarism
- Hate speech or illegal content
- Harmful, abusive, or unethical material
6. Editing, Proofreading & Publishing Support Disclaimer
Editing, proofreading, and formatting services improve quality but do not guarantee perfection or publishing acceptance by any platform or organisation.
Market access, publishing assistance, and distribution support are facilitation services only — outcomes depend on third-party platforms and author engagement.
7. Intellectual Property
- Clients retain ownership of their original work.
- Enigmatic Docs retains rights to design concepts or materials created until full payment is received.
- Completed work may be showcased in our portfolio or marketing, unless the client requests otherwise in writing.
8. Third-Party Services
Some services may involve third-party providers such as:
- Printing partners
- Registration bodies
- hosting or technology platforms
- payment processors
We are not responsible for delays, errors, or failures caused by third-party platforms, but we will assist in resolving issues where possible.
9. Limitation of Liability
Enigmatic Docs will not be liable for:
- Loss of sales, income, or opportunity
- Platform rejections or distribution outcomes
- Data loss or service interruptions beyond our control
Our liability, if applicable, is limited to the amount paid for the service.
10. Confidentiality
We respect client privacy and confidentiality. Manuscripts, files, and documents shared with us will not be disclosed to unauthorized parties, except where legally required.
11. Changes to Terms
We may update these Terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
